Jay-Z tries another tactic after the referee ruled that the woman is suing him can remain anonymous.
According to Rolling Stone and Deadlinerap mogul attorney, Alex Spirofiled new documents on Monday, Dec. 30, in an effort to challenge lawsuit accusing Jay-Z of rape as the alleged attack is alleged to have taken place months before a December 2000 law offering civil remedies to victims of gender-based violence went into effect. In December 2022, the New York City Council amended the law to allow people two years to file historic claims that would otherwise have expired.
“Plaintiff cannot recover her sole claim under the Gender-Based Violence Victims Protection Act (GMV Act) as a matter of law because the statute is not retroactive,” Spiro wrote in the letter Judge Analisa Torresafter the deadline.
He continued: “The plaintiff alleges a violation of the GMV Act for conduct that allegedly occurred in September 2000. However, the GMV Act was not enacted until December 19, 2000, three months after the FAC alleges that the conduct occurred and cannot be applied retroactively to create a cause of action that was not available to the plaintiff at the relevant time.
In a lawsuit filed earlier this month, Jay-Z's accuser, identified only as “Jane Doe” claimed she had been raped rapper and fellow musician Sean “Diddy” combs MTV Video Music Awards afterparty in 2000. She said she was 13 at the time. (Both Jay-Z and Diddy have denied the allegations.)
Last week, Judge Torres court documents said Jane Doe can remain anonymous after Jay-Z's attorney filed, TMZ has learned case closed and Doe's identity was revealed. However, the judge noted that circumstances could change as the case moves forward. Torres said she plans to revisit the matter if and when the case moves forward.
Torres also accused Spiro of being combative and trying to “expedite” the case according to the outlet.
A lawyer Tony Buzbywho represents Doe, the statement said Us Weekly“I usually do not comment on court rulings. I will say that the coordinated and desperate effort to attack me as an advocate for potential victims is falling apart.
Buzbee and Jay-Z are also embroiled in their own legal battle. Jay-Z — real name Shawn Carter — is suing Buzbee, accusing him of extortion and defamation. Buzbee filed his own lawsuit against Jay-Z's Roc Nation earlier this month, alleging that the firm bribed his clients to file lawsuits against his firm, threatened former clients and impersonated government officials. (Rock Nation called lawsuit “baloney”.)
