Trump will be sentenced under the new ruling

Roommates, looks like Donald Trump couldn't get out of this one! On Thursday, January 9, New York's highest court refused to block the conviction of the president-elect in his hush money case. The sentencing is scheduled for Friday.

One New York Court of Appeals judge issued a brief order refusing to grant a hearing to Trump's legal teams. So now the US Supreme Court is likely his last chance to avoid a hush money hearing. According to Associated PressTrump has already asked the Supreme Court to overturn Friday's ruling. His lawyers appealed to the state's highest court on Wednesday after New York courts refused to delay the ruling.

Judge Juan M. Merchan is scheduled to preside over the sentencing hearing. The dealer also managed Trump's trial and conviction last May on 34 felony counts of falsifying business records. Trump has consistently denied wrongdoing.

In a filing with New York's highest court, lawyers for Donald Trump said Mercen and the state's mid-level appeals court “erroneously failed” to stay the ruling. His team argued that the Constitution requires an automatic stay when they appeal. In addition, his lawyers said the ruling would disrupt the presidential transition. The president-elect is set to return to the White House on January 20.

Keep in mind that Judge Merchan already said he will not impose jail time, fines or probation. However, Trump's lawyers argued that a felony conviction would still have side effects, including distracting the president-elect during his transition.

Trump's lawyer, D. John Sauer, called the case politically motivated and said a conviction now would be a “gross injustice.” Sauer is also Trump's pick for solicitor general to represent the government at the high court.

Trump's lawyers also say the evidence used in the Manhattan trial violated a Supreme Court ruling last summer. The ruling gave Trump broad immunity from criminal prosecution for actions he took while president. They have said sentencing should be stayed while their appeals on the issue of immunity are heard.

Prosecutors and trial judges oppose Trump's legal team

However, prosecutors and appeals court judges resisted those stories. Prosecutors argued that the high court had no reason to take the “extraordinary step” of stopping the case. In addition, they have said that Trump's claims are not strong enough to overturn his conviction. In addition, they say his appeal should not freeze the case because it is about evidence, not the underlying charges.

“There is a compelling public interest in sentencing,” Manhattan prosecutors wrote. “The defendant has not provided any evidence for his claim that his duties as president-elect preclude him from physically attending the sentencing, which is unlikely to take more than an hour.”

Meanwhile, judges in New York have determined that Trump's criminal record is related to personal matters and does not match the Supreme Court's immunity ruling.
